Pittsburgh, PA, United States, November 5, 2026 -- Leading Pennsylvania attorney Bryan P. Keenan has emphasized a number of common errors that could prevent a successful Chapter 7 filing.

A Chapter 7 bankruptcy offers immediate relief from debt collection efforts, discharge from most unsecured debts, and a potential financial turnaround within months.

However, Bryan P. Keenan, of Bryan P. Keenan & Associates in Pittsburgh, PA, explained that, as part of qualifying for a Chapter 7 bankruptcy, an individual must file certain financial information as part of a means test to complete the process successfully.

One of the most common mistakes is failing to fully disclose income, he said. The bankruptcy court requires filers to report all sources of income, not just wages from a primary job. This can include rental income, side gigs, freelance work, bonuses, commissions and financial support to family members.

“Some wrongly assume small or irregular income should not be factored in, but it does,” Bryan P. Keenan warned. “An incomplete or inaccurate income report can raise red flags in the filing and may result in delays, requests for additional documentation, or allegations of fraud.”

Another grave error filers make is trying to hide assets by moving them out of their name to avoid them being sold to cover any debts before filing. Some filers have been known to protect property by transferring vehicles, bank funds, or valuable items to relatives. Others embark on a fire-sale, selling assets for less than fair market value.

Bryan P. Keenan said that these actions would be closely scrutinized as bankruptcy trustees routinely review financial transactions of past years. “If a transfer appears to shield assets from creditors, the trustee may reverse the transaction or deny the discharge altogether.”

Another frequent error is continuing to use credit cards or taking out loans shortly before filing for bankruptcy. Charges made close to the filing date, especially for non-essential purchases, can be presumed fraudulent.

He added: “Luxury purchases, cash advances, or large withdrawals leading up to a filing may be excluded from discharge or trigger objections from creditors. Any spending can raise questions if it appears excessive in claiming financial hardship.”

Another problem facing filers is making mistakes or omissions, as a Chapter 7 bankruptcy requires extensive documentation, including schedules listing assets, debts, income, expenses, and recent financial transactions.

Common paperwork errors include undervaluing assets, misclassifying debts, forgetting creditors, or failing to sign required forms. “Accuracy and transparency are vital to the process,” he said. “Such inconsistencies can delay the process as a bankruptcy trustee will request amendments or additional information.”

Filing at the wrong time can also scupper a filing, as a Chapter 7 means test evaluates income over the prior six months. Launching the process shortly after receiving a bonus or temporary overtime can make a filer appear ineligible even if their income has since dropped. “In some cases, waiting a few months before filing can change the outcome entirely,” he said.

Bryan P. Keenan urged filers to communicate openly with the bankruptcy trustee, as they are more powerful in the filing process than is commonly assumed. Some filers underestimate the role, viewing the trustee as an administrator. In reality, trustees actively review filings, question inconsistencies, and investigate potential abuse.

Failing to cooperate, missing document requests, or being unprepared for the 341 meeting of creditors can also lead to delays or dismissal.

Selecting the wrong exemptions or failing to claim them properly can result in losing property a person might otherwise have been able to keep, such as equity in a vehicle or funds in a bank account.

He urged potential filers to seek advice from a bankruptcy attorney as it will reduce the risk of costly errors or easily preventable misunderstandings if they decide to go it alone in the bankruptcy process.

Bryan P. Keenan concluded: “Even if a Chapter 7 bankruptcy filing is successful, the filer should have a strategy in place so that they don’t fall back into debt in the long-term. Bankruptcy done right and properly can be a turning point.”
